Cop fined for not surrendering guns

A senior member of the Jamaica Constabulary Force was fined $800,000 or six months' hard labour in the Spanish Town Resident Magistrate's Court yesterday.

Deputy Superintendent of Police Albert Diah, of the St Catherine South Police Division, was fined for breaches of the Independent Commission of Investigation Act.

The fine was handed down by Resident Magistrate Anmarie Nembhard.

His conviction arose from an August 2013 incident after an alleged shoot-out between the police and gunmen in Windsor Heights, Central Village.

Witnesses for the INDECOM testified that the day in question personnel went to the Central Village Police Station.

The team had investigated the fatal shooting of a woman and instructed the DSP to hand over the guns involved.

Diah refused to hand over five guns involved in the shooting.

He was subsequently summoned and have made numerous court appearances.

In his defence, Diah said that he was not aware if INDECOM has the ultimate authority to prosecute him.

He was defended by attorney-at-Law Peter Champagnie.

The INDECOM prosecution was led by Richard Small.
