Nuisance of a neighbour

There have been numerous complaints about people who have been disturbing the peace and quiet of their neighbours. A couple who bought their dream home in 1995 are now planning to sell it because one of their neighbours has become a nuisance to them.

According to the couple, when they bought the house they had intended to live there for the rest of their lives.

"Two years ago, one of our neighbours who lived alone decided to sell her house because she wanted to live with her daughter in Kingston," the couple said.

"A man and his wife bought the house and since then, the husband has become a real nuisance. He curses his wife disgracefully. He is always shouting at her and this kind of behaviour takes place almost every day.

"Things became so bad last month that I had to talk to him about his behaviour. He became very boisterous towards me. He cursed me, telling me that I should not interfere in his business.

"I told him the way he was treating his wife was everybody's business. I explained to him that he was disturbing my sleep at nights when he shouts and curses his wife. I told him that when I bought my house in 1995 for $10 million and spent extra money to refurbish it, I did not expect to have neighbours like him. I even told him that because of him we were going to sell our house.

"While I was talking to him by the fence, he became very angry. He picked up a stone and threw it at me and it hit me on my shoulder. I went to the police station and made a report and he was arrested for wounding me. He went to court, pleaded guilty and he was fined.

"I had to go to the doctor several times because of the injury to my shoulder. I also had to buy the medication at the pharmacy. I think he should pay me for my medical expenses. He apologised to me for injuring me. When I told him about the medical expenses he said he was not paying me. He said there was no need for me to go to the doctor when I could get free treatment at the health clinic. What can I do to get back my money?"

You can sue him to recover your medical expenses. The court will make an order for him to pay you. If he refuses to pay, then you can contact the bailiff, who will take the necessary steps for you to get your money.
