No order made in assault case

A no order was made in the Corporate Area Resident Magistrate's Court Wednesday after an accused man apologised profusely to the elderly complainant.

Charged with assault occasioning bodily harm is Derrick Stubbs, who pleaded not guilty.

The court heard that Stubbs used his fist to hit the elderly woman in her face, causing swellings and bruises. He also used a wire to hit the woman over her body.

Stubbs told Resident Magistrate (RM) Judith Pusey that he and the woman had a misunderstanding which blew out of proportion, but that he had apologised and the complainant wanted to drop the matter.

The RM asked the accused if he had hit her but he repeated that he had a misunderstanding with the woman and that his hand may have caught her. This caused laughter to fill the court.

Stubbs was then made to apologise to the woman and no evidence against him was offered.
