Cop found with 47 rounds of ammo at home freed |

BARBARA GAYLE, STAR Writer A policeman found with 47 rounds of ammunition at his home in Portmore, St Catherine, has been freed. Corporal Devon Miller from the Constant Spring Police Station, was charged in June last year. The Crown led evidence at his trial in the Gun Court, that on June 8, police, acting on information, accosted Miller and took him to his home. Miller's room was searched and 20 M16 rounds and 27 other rounds were found. In his defence, Miller said the night before his room was searched, a licensed firearm holder had accosted a boy who ran leaving the bag with the ammunition. He said he did not get the opportunity to take them to the station because he received an emergency call from one of his colleagues. A licensed firearm holder testified that he took the ammunition from the boy and gave them to Miller. Miller's attorney Peter Champagnie, submitted that the Firearms Act gave a policeman the lawful authority to have the ammunition once he received it in the capacity as a lawman. Justice Courtney Daye, in freeing Miller, said while his conduct could be negligent, he had a doubt. The judge said the Crown could not challenge Miller's explanation. |
