Is it too late to file a lawsuit?

A man who was hit in the right eye two years ago has to be undergoing treatment and is fearful that he might become blind in that eye.

He says he feels terrible pain in the eye and can hardly sleep at nights.

According to the man, he and his friends were playing football one afternoon when the ball hit a man who was passing by.

"After the ball hit the man on his foot, the man began to curse us, saying we were idlers and should not be kicking ball on the road.

"We told him we were sorry that the ball hit him but that just made the man more angry. He continued cursing and when a woman who is his neighbour called to him to stop the cursing, he turned his attention to cursing the woman.

"One of my friends shouted to him to stop telling the woman such filthy words and he took up a stone and threw it at my friend. The stone caught me in my right eye and I had to be taken to the hospital.

"The man was charged with assault and when he went to court he pleaded guilty and was fined. Although the incident took place two years ago, I am still having pains in my right eye and have to be going to an eye specialist on a regular basis, and it is very expensive.

"Last week I was talking to a policeman who suggested that I could sue the man for the damage to my eye. The man owns some minibuses and has a businessplace, so I know he can afford to pay.

I am wondering about it because I don't really like the courthouse business and I would not want to go to court and lose. When I told my friends about it, they said they were willing to be witnesses because they were present when I was injured," he said.

It is not too late for you to file a suit against the man to recover damages for pain and suffering as well as money for medical expenses. You will have to get a medical report from your doctor as to the condition of your eye.

You should consult a lawyer so that the suit can be filed against the man who injured you. If you wait until six years have passed from the time of the incident, then your suit will be statute-barred. The law states that civil suits must be filed within six years from the cause of action.
