CLASH OVER DOG WASTE

A dog owner and a woman, who had kicked and body slammed the animal after they had an argument about the canine's excrement, were each bound over to keep the peace in the sum of $5,000 or 12 months in the Corporate Area Resident Magistrate's Court yesterday.

The co-accused, Jurdine Wint, and Peter Miller were charged with assault occasioning bodily harm, each identified the other as the aggressor as the details unfolded before the court.

Miller told the court that on the day of the incident he was walking his dog as is customary for him in the Cooreville Gardens community when he overheard someone shouting in his direction asking, "Why yuh always carry the dog come ... down here?"

He said the person who made the comment was Wint.

Miller admitted to the court that he made a vulgar reply.

Wint then approached him and kicked the dog twice and hit the dog with a stone.

Miller said he pushed at Wint and she hit him with a stone on his right side. He then retaliated and threw a stone in Wint's direction.

According to him, Wint then walked up to him and held the belt which was attached to the dog and used it to body slam the dog about three times.

The belt then burst and the dog ran off.

Wint explained that the dog had become a nuisance because it kept passing excrement in a particular part of the community that she cleans regularly and blamed Miller for not cleaning up after the dog.

A report was later made to the police.

Miller told the court that he incurred total medical costs of $5,800; $3,800 for a veterinary visit for the dog and $2,000 for his own visit to the doctor.

Meanwhile, Wint said she had spent $7,000 for her medical expenses.

Miller was then ordered by the court to pay over the difference of $1,200 to Wint as reimbursement.
