BLIND ALLEY - Eyewitness in Clansman leader's case killed

The sole eyewitness in the case of reputed leader of the Clansman gang, 27-year-old Tesha Miller, has been shot dead.

It was reported that the witness was fatally shot in St Elizabeth in August.

Miller appeared in the Home Circuit Court yesterday but his case was put off to November 3. Prosecutors told the court that the trial could not proceed because of a murder trial which is continuing for the third week.

Miller is to face trial for the murder of Rohan Haughton who was fatally shot in Spanish Town, St Catherine, in April 2004.

Statement as evidence

The Crown will have to proceed under the Evidence Amendment Act so that the statement can be tendered in evidence. Prosecutors said they received the post -mortem report in relation to the witness and further statements in the case and will serve copies on Miller's lawyers. Attorney-at-law Valerie Neita Robertson said she was upset that the trial which was set for priority yesterday had to be put off.

Attorney-at-law Everton Bird who is also representing Miller asked Supreme Court Judge Lloyd Hibbert if he would consider an application for Miller to be granted bail. The judge denied the request.

Miller's bail was revoked in July because he had breached one of the conditions of his bail.The court was told that a curfew was imposed on Miller but when the police visited his home, he was not there.

Miller is also facing a triple murder charge but that case has been set for mention on October 3 for a trial date to be set.
